قانون وضعي جنائي او جناحي من تكريس ذلك المبدأ [1] سواء بالتأكيد على وجوب نص سابق او بالتأكيد على قاعدة عدم رجعية القوانين الجزائية في الزمن. قد يبدو من البديهي وجود مثل تلك القاعدة في القوانين ينص كذلك على ذلك المبدأ في ماته 15 :" لا جريمة ولا عقوبة إلا بنص تشريعي سابق، ويطبق في جميع الأحوال القانون الأصلح للمتهم." الا ان التذكير بتأصيل المبدأ يظل من الأهمية بمكان. يكرس مبدأ علوية القانون من الناحية الإجرائية او الشكلية ويمكن تأصيله بأسباب تاريخية تزامنت وتطورت مع مفهوم الدولة الحديثة ومختلف المحطات التي عرفها الفكر الإنساني في عقلنة علاقة الفرد بالسلطة ومن ثمة الدولة و القانون ولما كان الامر يتعلق بالشرعية و التشريع كان من المنطقي ان تتولى الدولة ممثلة في أجهزتها المختصة و عبر القانون بوصفه التعبير عن السيادة الوطنية و ممارستها باسم المجموعة او المجتمع وهي الوحيدة التي لها شرعية تحديد السلوك المجرم بوصفه تهديدا او ضررا للمجتمع او الشعب التي تمثله على ان ممارسة هذا الاختصاص من الدولة او بصفة اخص الجهاز التشريعي ليس مطلقا بل يخضع لضوابط في الشكل و المحتوى وهو ما يسمح بالتوقي من تسلطه و عدم نيله من سائر المبادئ العامة التي تنظم المواد القانونية بصفة عامة و المادة الجنائية بصفة اخص على ان هذا التقييد لا يقف عند السلطة التشريعية اذا انها بممارسة ما لها من مهام ترسم حدود ممارسة القاضي للسلطة القضائية فدون نص سابق الوضع لا يخل للقاضي قطعا اختراع جرائم او توقيع عقوبات لم ينص عليها المشرع بما يضمن الحقوق و الحريات لجهة الفرد و الفصل والتوازن بين السلط لجهة المجموعة . كان آلاف المهاجرين الافارقة من جنوب الصحراء يعيشون أوضاعا جدّ صعبة في تونس، بين خطابات عنصرية تجرّم وجودهم في تونس وتهجير قسري إلى الحدود الليبية والجزائرية، تسبب في عديد الوفيات في الصحراء، كما تعالت أصوات منظمات حقوقية دولية تعتقد أن إمضاء هكذا اتفاقية مع الحكومة التونسية، في تجاهل تام لما يحدث من انتهاكات لحقوق الإنسان وفي واقع حكم فردي قمع كل سلطة مضادة وضرب كل المؤسسات المستقلة، هو غض الطرف عن مبادئ شراكة سابقة تنصص في فصولها على ضرورة احترام حقوق الإنسان وهذا يعتبر تزكية للأنظمة الاستبدادية في جنوب المتوسط، أنظمة اتقنت، عبر تجربة عقود، ابتزاز الدول الغربية بعد ما تأكدت من أن "الاتحاد يدرّ عائداتٍ كبيرةٍ على الأفراد والجماعات المسلحة ومؤسسات الدولة. كما تلقّت الكيانات التابعة للدولة في ليبيا دعماً تقنياً ولوجستياً ومالياً من الاتّحاد الأوروبي والدول الأعضاء فيه، لاعتراض المهاجرين وإعادتهم إلى ليبيا، من بين جملة من الأمور الأخرى..." هذا وقد تواترت التقارير الدولية عن الانتهاكات الصادمة التي يتعرض لها المهاجرون في ليبيا. وقد صدرت هذه التقارير بشكل مطرد عن مؤسسات مختلفة بعضها دولي وبعضها الآخر ينتمي إلى المجتمع المحلي. وقد أماطت هذه التقارير اللثام عن تفاصيل مروعة لجرائم يتعرض لها المهاجرون وطالبو اللجوء على الأراضي الليبية. وهذا المقال هو محاولة لتقصي أسباب الإفلات من
